I. PROCESSING OF PERSONAL DATA

Access to, and consultation of, the website www.atam.it (hereinafter the “Website”), with particular reference to the sections “Work with us”, “Request a catalogue” or “Contact us” on the Contacts page of the Website, as well as a subscription to the “Newsletter” provided on the homepage of the Website itself, may entail the processing of personal data by ATAM S.p.A, with registered office in 20131 Milan (Italy), viale Lombardia No. 8, tax code and VAT number IT09868530156 (hereinafter the “Company”), which shall be carried out in compliance with current applicable laws and regulations. Current legislation on the protection of personal data of natural persons provides for the requirement to provide data subjects with adequate information when personal data concerning them is collected. This document, updated on 20 March 2023, thus contains a summary of information on the procedures, terms and conditions of the processing by the Company of any personal data collected via the Website and is subject to change, the publication of which shall be posted on this page of the Website and shall indicate its effective date.


II. ROLES IN THE PROCESSING OF PERSONAL DATA

The processing of personal data addressed herein involves, in addition to the person to whom the processed data refers (the “Data Subject”), the Company indicated above (the “Data Controller”), in the person of its legal representative pro tempore, who may be contacted at the following email address: info@atam.it. 

The Company has furthermore appointed a number of external data processors (hereinafter referred to as the “Processors”) in the processing of your data, and specifically companies in charge of providing services relating to the management and maintenance of the Company’s processing systems or their components: a complete list of the Processors appointed by the Company shall be provided following a specific request to be sent by email to the Data Controller at the above address. 


III. TYPES OF DATA PROCESSED 

3.1 Browsing data and purpose of processing

In a number of cases, the computer systems and software procedures used to operate the Website acquire, in the normal course of operation, certain personal data, the transmission of which is implicit in the use of Internet communication protocols. This refers to information that is not collected to be associated with identified data subjects, but which by its very nature might allow users to be identified. This category of data includes the IP addresses or domain names of the computers of users who connect to the Website, the URI (Uniform Resource Identifier) of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment. This data is only used to obtain anonymous statistical information on the use of the Website and to monitor that it is functioning correctly, and is deleted immediately after processing. This data may also be used to ascertain liability in the event of hypothetical computer crimes affecting the Website. 

The legal basis for the processing of data in these cases is the legal relationship established through access to the Website by the Data Subject and the legitimate interest in acquiring tools to improve the service provided to Website users and to comply with legal obligations (e.g. with regard to the identification of potential offenders). 

3.2 Data voluntarily provided by the Data Subject

The optional, explicit and voluntary submission of personal data by the Data Subject to the Company’s email addresses on the Website, or by means of registration, entails the acquisition and processing by the Company of the data provided by the Data Subject, which is required for the provision of the service or the delivery of the requested information. Specifically, processing of the data submitted to or acquired by means of the Website shall be carried out for the purposes of outlining an authentication profile that is required for the user to access the Website at their discretion, to outline the user's profile in order to optimise and customise the services available following registration, as well as to the extent that is necessary to fulfil the obligations and exercise the specific rights of the Data Controller or the Data Subject in connection with the Data Subject's access to the “Work with us” sections , “Request a catalogue” or “Contact us” on the Website’s Contact page or as a result of subscribing to the “Newsletter” provided on the Website’s homepage: communication of the Data Subject’s data to the Data Controller is required in order to allow, respectively, the following: (i) comparison of the information provided with available job opportunities; (ii) delivery of catalogues of products and services provided by the Company; (iii) response to requests for information from the Data Subject to the Company for any reason or purpose; and (iv) delivery of newsletters and informative communications, whereby failure to provide such information would result in the inability to fulfil the requested activities. In the latter, expression of the Data Subject's express consent to data processing is required by completing the relevant box. Specific consent is also required for subscription to the Newsletter, which includes the periodic delivery of informative communication to the address of the Data Subject, with the option of expressing cessation of consent by means of a declaration of withdrawal to be forwarded by accessing the link at the bottom of each email by the Company.

The legal basis for the processing of data is, therefore, in these cases the specific consent expressed by the Data Subject and the requirement to proceed with the processing in order to handle requests for collaboration or other requests sent to the Company when accessing the Website and to send communications relating to the Company. 

3.3 Data from minors

The Website and the services provided on it are not intended for persons under eighteen (18) years of age. In the event that the Company collects or receives personal data from persons under eighteen (18) years of age, the Data Controller shall delete the aforementioned personal data



IV. COOKIES 

Please note that in order for the Website to function correctly, only technical cookies are used, whereas no profiling cookies of the Data Subject or of third parties are used during the Website’s operation. The Website makes use of the features provided by the Google Analytics 4 (GA4) service to collect information concerning the use of the Website for the purposes of improving it. To collect this information, Google Analytics 4 may set cookies on the Data Subject’s browser or read any existing cookies, as well as receive information regarding the Data Subject from applications downloaded by the Data Subject and working with Google. The Company merges information collected via the use of Google Analytics 4 with identity information. The ability of Google to use and share the information collected by Google Analytics 4 concerning the Data Subject's visits to the Website or other Google partner applications is limited by the Google Analytics Terms of Service and the Google Privacy Policy available at https://policies.google.com/technologies/partner-sites.



V. COOKIE MANAGEMENT

The Company wishes to remind you that the full or partial disabling of technical cookies (i.e. navigation cookies, which allow the Website to function correctly and enable the provision of the relevant services requested by the user) may compromise the use of the Website’s functionality.  Users may, however, decide whether or not to accept cookies by modifying the security settings in their browser. VI. OPTIONAL PROVISION OF DATA

With the exception of that which is specified for browsing data, the Data Subject is free to provide their personal data. Failure to do so may, however, result in the failure to obtain the requested information or may result in a limitation in the use of the Website. 


VII. PROCESSING PROCEDURES AND PERIOD OF RETENTION

Personal data is processed, even with the aid of automated tools, for the time strictly necessary to achieve the purposes for which it has been collected and in all cases up to a maximum period of ten years from the date of its acquisition by the Company in order to allow the latter the right of defence in the event of litigation. Specific security measures are observed to prevent loss of data, unlawful or incorrect use and unauthorised access. The Company has taken appropriate technical and organisational measures to ensure a level of data security commensurate with the risk.


VIII. DATA SHARING, COMMUNICATION AND DISSEMINATION 

The data collected may be transferred or communicated not only to Data Processors, but also to Company personnel who, operating under the direct authority of the Data Controller, process data in their capacity as persons responsible for such processing and who receive adequate operating instructions in this regard from the Data Controller, as well as to other companies for activities strictly connected with, and instrumental to, the operation of the service, such as management of the IT system. Personal data may be disclosed to third parties, but only and exclusively in the event that such disclosure is necessary to comply with requirements of the Financial, Administrative and Judicial Authorities or of Public Security, and the Data Controller rules out that the data will be disclosed to a country outside the European Union or to international organisations, it being understood that, should this prove necessary, specific information shall be provided and appropriate contractual measures shall be taken to ensure appropriate protection of personal data, including the implementation of agreements based on standard contractual clauses adopted by the EU Commission.


IX. RIGHTS OF THE DATA SUBJECT

For the entire duration of the retention period of the Data Subject’s data, the Data Subject shall have the right to:
  • request from the Controller access to your data and to be made aware of the methods and purposes for which said data is processed, to have it corrected or deleted when incomplete or erroneous, or collected in violation of the law;
  • limit processing, or object to it, in the conditions provided for by current legislation;
  • receive in a structured, commonly used and machine-readable format, the personal data relating to them at the end of the retention period;
  • file a complaint with a supervisory authority - GPDP - (Garante per la Protezione dei Dati Personali).
